Student Agreement
General Terms and Conditions
General terms and conditions apply to all services provided by Fission Education.
Definitions:
Tutoring Centre / Centre / Our / We: Refers to Fission Education, located at 32 Derna St, Bardia, 2565, NSW, Australia.
Student: Refers to the individuals receiving tutoring services provided by Fission Education.
Services: Refers strictly to the tutoring services provided by Fission Education.
Background:
All students who are enrolled in Fission Education accept this agreement upon enrolment. If the student is under the age of 15 a parent or guardian must accept the student agreement on their behalf.

Fission's Promise:
We will:

Provide tutoring services to the student using reasonable care and skill.

Ensure that the services provided are suitable to assist in developing the confidence and academic ability of the student.
Student Obligation:
We will do everything we can to assist the student, however, we also need cooperation from the student. Students enrolled in Fission Education agree to:

Attend all classes.

Provide details of the student's results/grades at school in the subject for which they are receiving tutoring.

Complete the provided classwork and homework to the best of the student's ability.

Help Fission Education tutors identify areas in which the student needs help.

Only contact tutors through approved communication channels. This is important as we have a duty of care.

Treat all students and staff at Fission Education with courtesy and respect.

Follow the reasonable directions of Fission Education Tutors and Employees.

The student agrees that under no circumstance are Fission Education tutors to complete homework or assignments on behalf of the student.

Trial Lessons:
A student is allowed to attend one trial class for each course offered for their grade free of charge. Trial lessons are not open to students who have previously enrolled in that course for that grade. Once the student has attended the trial lessons they must enrol in the course if they wish to continue attendance.

Satisfaction Guarantee:
While we try our best to provide tutoring for the student we understand that each student has different requirements and learning styles, hence Fission Education may not be the best fit for every student. If a student enrols in Fission Education and, acting reasonably, is dissatisfied with our service then the student may unenrol from tutoring and we will refund all future sessions not including any payment processing fees. The following conditions must have been satisfied:

the student attends and actively participates in all scheduled classes.

the student completes all work assigned in class and as homework.

provides evidence of grades before enrollment at Fission Education and during the student's attendance of Fission Education.

Missed Class Policy:
If the student is to miss a class rescheduling the class is subject to tutor availability. Reasonable efforts shall be made to accommodate the availability of students when rescheduling 1-on-1 classes. However, no refund or credit shall be provided if a student is to miss a group class. The learning material and notes provided during the missed class will be available for the student after the lesson.

If it is not possible to reschedule a missed class no refund shall be provided for that class.
Usage of Fission Education Teaching Materials:
The learning material provided is the property of Fission Education. Students are permitted to use said materials during their enrollment at Fission Education. A student may continue to use any physical materials provided during their enrollment for their personal use. Each student agrees that the material provided shall not be copied or distributed to third parties under any circumstance.
Publication of Results:
The student agrees that Fission Education may publish the academic results of the student. This includes but is not limited to; improvement a Student demonstrates over the period they are taught at Fission Education, or their results achieved in state-standardised tests such as the NAPLAN, HSC and ATAR results.

Only the student's first and last name, as well as the result, shall be published. No other information shall be used without the student's consent (i.e. photographs).
Payment:
Payment shall be made no later than the immediate completion of the agreed upon lessons. Payment may also be made in advance for multiple lessons. If payments are delayed beyond the completion of the agreed upon lesson Fission Education holds the right to cease the agreed upon tutoring service until the payment has been made, or terminate the agreement entirely.
Rescheduling and Cancellation of 1-on-1 Tutoring Classes:
You may cancel a 1-on-1 tutoring session no less than 48 hours before the scheduled sessions.

If payment has already been made for a cancelled lesson it can be carried forward to next week's lessons. However, if the student consistently misses lessons Fission Education holds the right to cease providing tutoring services to the student. This is as we believe that inconsistent effort does not yield results and is not beneficial to the student while also taking up time slots from other students who may wish to attend Fission Education.
Australian Consumer Law, Termination and Refunds:
Fission Education services come with the guarantee that comply with the terms of the Australian Consumer Law. For major failures related to the service provided by Fission Education, the student is entitled to:

to cancel your service contract with us; and

to a refund for the unused portion
​
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.

If the failure does not amount to a major failure, the student is entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel the contract and obtain a refund for the unused portion of the contract. For more information on your rights see:

A major failure could occur where our Services:

Have a problem that would have stopped You buying if you had known about it
-
Are not fit for their purpose i.e. to teach the Course material and this cannot be fixed in a reasonable time

Do not fit your specific purpose and this cannot be fixed in a reasonable time
-
Are unsafe

In these cases of major problems the student is entitled to ask for a replacement of Fission Education services or a refund. Where the student is entitled to, and request, a refund the student must return all materials that we have provided and cease accessing Fission Education learning systems.

In the case of minor problem we will use our reasonable endeavours to correct any problem within a reasonable time of being informed of it. We may, at our discretion, provide credits against future service or permit cancellation of the contract to provide tutoring services. Except as outlined above or as provided in the Australian Consumer Law, fees are non-refundable. This includes in cases of change of mind or change to a student’s timetable. If we do agree to a refund and we are not required to do so there is an administration fee of $60 per course. This fee covers the administration necessary to remove enrolled students and process refunds.
General Liability:
Whilst Fission Education will take reasonable care to control what occurs at Fission Education centres, Fission Education Tutors and Staff are not responsible for any personal property that is brought to the centre. Fission Education accepts no risk in respect of that personal property.

The student agrees that if any damage is to occur to Fission Education property, the student will, on-demand from Fission Education, pay the reasonable costs of repairing the damage incurred.
Work Health and Safety:
Fission Education is required to take reasonable care of the health and safety of all people who enter Fission Education centres. All students and parents or guardians (where the student is under 18 years of age) are expected to comply with reasonable directions from Fission Education Staff regarding work, health and safety.

Where a student repeatedly fails to comply with reasonable directions from Fission Education staff we are entitled to terminate the provision of our services. Unless the student's conduct presents serious risk of harm to themselves or others we will not terminate the services provided without first trying to work with the student and their parent or guardian to improve the student's conduct.
Entire Agreement:
This agreement constitutes the entire understanding between the parties and supersedes all previous agreements and understandings.
